OUG - Article 60

(1) Traffic participants must show increased prudence when approaching and crossing the lines of the current or industrial railway, as applicable.
(3) At the level crossing with an industrial railway, properly signalled, the drivers of vehicles are obliged to comply with the meaning of the signals of the railway agent.

 

Regulation - Article 68

The approach to a level crossing with the railway is signalled with appropriate warning signs and/or with additional panels for the level crossing with the railway.

Regulation - Article 73

(1) At the level crossing with an industrial railway, the "Other dangers" sign is installed, accompanied by an additional panel containing the image of a locomotive.

(2) When a railway vehicle moves on the industrial railway, the traffic must be directed by a railway agent.

Regulation - Article 136

(1) At the level crossing with the current railway, the driver of the vehicle is obliged to drive with reduced speed and to make sure that from the left side or from the right side no railway vehicle is approaching.

(2) When crossing the railway, pedestrians are obliged to make sure that from the left or from the right no railway vehicle is approaching.

Regulation - Article 137

(2) When the traffic at the level crossing with the current railway is directed by railway agents, the driver of the vehicle must respect their signals.

Regulation - Article 140

(1) At the intersection of a public road with an industrial railway, the access of railway vehicles is carried out only after proper and timely signalling by at least one railway agent.

(2) In the case provided in paragraph (1), the drivers of vehicles are obliged to comply with the meaning of the signals of the railway agents.

SPECIAL PLACES AND SITUATIONS

There are places and situations on the public road where the driver of the vehicle cannot drive in normal conditions, these places create obligations.

The special places and situations that we are going to discuss are:

  • Level crossing with the railway;
  • Pedestrian crossing;
  • The road in a curve;
  • The top of a slope/downhill.

LEVEL CROSSING WITH THE RAILWAY

The level crossing with the railway is the place where the public road crosses the railway.

The approach to a level crossing with the railway is signalled with appropriate warning signs and/or with additional panels for the level crossing with the railway (art. 68 of the Regulation).

THE LEVEL CROSSING WITH THE RAILWAY MAY BE:

  • INDUSTRIAL;
  • CURRENT, which may have barriers or no barriers.

We will encounter the "Other dangers" sign accompanied by the additional sign "Level crossing with industrial railway", which contains the image of a locomotive (art. 73 paragraph 1 of the Regulation).

When a railway vehicle moves on the industrial railway, the traffic must be directed by a railway agent (art. 73 paragraph 2 of the Regulation and art. 140 paragraph 1 of the Regulation).

OBLIGATIONS OF THE DRIVER OF THE VEHICLE at the level crossing with the industrial railway:

  • to show increased prudence (art. 60 paragraph 1 of the OUG);
  • to comply with the meaning of the signals of the railway agent (art. 60 paragraph 3 of the OUG and art. 140 paragraph 2 of the Regulation);
  • to make sure that on the railway no railway vehicle is moving;
  • to stop at the appearance of a railway vehicle.

The level crossing with the current railway is pre-signalled with the following signs:

The panels are installed at:

  • 150 m (three inclined stripes);
  • 100 m (two inclined stripes);
  • 50 m (one inclined stripe).

When crossing the railway, pedestrians are obliged to make sure that from the left or from the right no railway vehicle is approaching (art. 136 paragraph 2 of the Regulation).

When the traffic at the level crossing with the current railway is directed by railway agents, the driver of the vehicle must respect their signals (art. 137 paragraph 2 of the Regulation).
