Driving a vehicle without a driving licence
(1) Driving on public roads of a motor vehicle, a tram or an agricultural or forestry tractor by a person who does not hold a driving licence is punished with imprisonment from one to 5 years. (Paragraph (1) of Art. 335 was amended and updated on Școala Rutieră on 09-07-2023)
(2) Driving on public roads of a vehicle for which the law provides the obligation to hold the driving licence by a person whose driving licence is not appropriate for the category to which the respective vehicle belongs or whose licence was withdrawn or annulled or whose exercise of the right to drive was suspended or who does not have the right to drive motor vehicles, trams or agricultural or forestry tractors in Romania is punished with imprisonment from 6 months to 3 years or with a fine. (3) With the same penalty is also sanctioned the person who entrusts a vehicle for which the law provides the obligation to hold the driving licence for driving on public roads to a person about whom they know that they are in one of the situations provided in par. (1) or par. (2) or under the influence of alcohol or psychoactive substances.

Driving on public roads of a vehicle for which the law provides the obligation to hold the driving licence by a person whose driving licence is not appropriate for the category to which the respective vehicle belongs or whose licence was withdrawn or annulled or whose exercise of the right to drive was suspended or who does not have the right to drive motor vehicles, trams or agricultural or forestry tractors in Romania is punished with imprisonment from 6 months to 3 years or with a fine (art. 335 par. 2 of the Criminal Code). + the retention of the driving licence for its annulment. (a replacement proof without the right to drive is issued).
With the same penalty (imprisonment from 6 months to 3 years or with a fine) is also sanctioned the person who entrusts a vehicle for which the law provides the obligation to hold the driving licence for driving on public roads to a person about whom they know that they are in one of the situations provided in the two earlier articles or under the influence of alcohol or psychoactive substances (art. 335 par. 3 of the Criminal Code).
