Criminal Code - Article 334

Putting into circulation or driving an unregistered vehicle

(1) Putting into circulation or driving on public roads a motor vehicle, a tram or an agricultural or forestry tractor unregistered or unrecorded, according to the law, is punished with imprisonment from one to 3 years or with a fine. (Paragraph (1) of Art. 334 was amended and updated on Școala Rutieră on 09-07-2023)

(2) Putting into circulation or driving on public roads a motor vehicle, tram, agricultural or forestry tractor with a false registration or recording number is punished with imprisonment from one to 5 years or with a fine. (Paragraph (2) of Art. 334 was amended and updated on Școala Rutieră on 09-07-2023)

(3) Towing an unregistered or unrecorded trailer or with a false registration or recording number is punished with imprisonment from 3 months to 2 years or with a fine.

(4) Driving on public roads a motor vehicle, a tram or an agricultural or forestry tractor or towing a trailer whose registration or recording number plates were withdrawn or a vehicle registered in another state which has no right of circulation in Romania, is punished with imprisonment from 6 months to 2 years or with a fine. OFFENCES IN ROAD TRAFFIC: these are those offences in which the traffic rules were violated and which by themselves entail criminal liability. These can be punished with imprisonment, criminal fine and the cancellation of the driving licence.

In general, the offences can be classified according to the following criteria:

• Offences related to REGISTRATION;
• Offences related to the DRIVING LICENCE;
• Offences related to the consumption of ALCOHOL or other prohibited substances;
• Offences related to TRAFFIC ACCIDENTS;
• MISCELLANEOUS offences.

Offences related to REGISTRATION:

Putting into circulation or driving on public roads a motor vehicle, a tram or an agricultural or forestry tractor unregistered or unrecorded, according to the law, is punished with imprisonment from one to 3 years or with a fine (art. 334 paragraph 1 of the Criminal Code) + the retention of the driving licence is ordered for its cancellation. (a replacement proof is issued with the right of circulation for 15 days).

Putting into circulation or driving on public roads a motor vehicle, tram, agricultural or forestry tractor with a false registration or recording number is punished with imprisonment from one to 5 years or with a fine (art. 334 paragraph 2 of the Criminal Code). + the retention of the driving licence is ordered for its cancellation. (a replacement proof is issued without the right of circulation).

Towing an unregistered or unrecorded trailer or with a false registration or recording number is punished with imprisonment from 3 months to 2 years or with a fine (art. 334 paragraph 3 of the Criminal Code) + the retention of the driving licence is ordered for its cancellation. (a replacement proof is issued with the right of circulation for 15 days).

Driving on public roads a motor vehicle, a tram or an agricultural or forestry tractor or towing a trailer whose registration or recording number plates were withdrawn or a vehicle registered in another state which has no right of circulation in Romania, is punished with imprisonment from 6 months to 2 years or with a fine (art. 334 paragraph 4 of the Criminal Code). + the retention of the driving licence is ordered for its cancellation. (a replacement proof is issued without the right of circulation).
