THE OFFENCE: the particularly serious act, which presents a social danger, being committed with guilt and which is provided by the criminal law and is punished by it.
THE CONTRAVENTION: any failure to comply with a traffic rule, provided that it is not an offence, having a lower degree of social danger than the offence.
We must remember from the beginning the following four terms.
The retention of the driving license is done in all cases until the resolution of the cases that led to this.
The suspension of the driving license is the suspension of the right to drive and is done for a limited period of time between 30 and 120 days.
The cancellation of the driving license is the annulment of the document, its holder remains permanently without a driving license, and in order to be able to drive again must obtain a new driving license.
The withdrawal of the driving license is done in the situation in which the driver of a motor vehicle or of a tram is medically unfit to drive motor vehicles or trams. If the respective condition can be treated and the doctor states that he has become fit again to drive motor vehicles or trams, the withdrawn driving license will be returned to him.
We must remember that for suspension, cancellation and withdrawal, a retention of the driving license is done before these.
