The driving exam will be recorded AUDIO-VIDEO!

The driving exam will take place according to new rules starting in 2017, according to the latest legislative amendments.

OUG 41/2016, which contains provisions meant to simplify the existing administrative procedures, thus amends the Government Emergency Ordinance no. 195/2002 regarding road traffic, republished.

According to the new articles, the driving exam will take place according to new rules: its theoretical test will be recorded video, and the practical one will be recorded audio and video.

The measures were taken by the Government to reduce the risks of corruption in obtaining the driving license.

At article 23, after paragraph (9) four new paragraphs are introduced, paragraphs (9-1)-(9-4), with the following content:

"(9-1) For ensuring and verifying the legality of the driving license exam, the manner of carrying out the theoretical test is recorded video, and in the case of the practical test both video and audio, with technical monitoring systems. For the practical test, the technical monitoring systems are installed on the motor vehicles used for taking the practical test.

(9-2) By exception from the provisions of par. (9-1), the practical test taken for categories AM, A1, A2 and A is not recorded audio or video.

(9-3) The technical monitoring systems provided in par. (1) are ensured by the community public service for driving licenses and vehicle registration that organizes the driving license exam.


(9-4) The procedure and the technical conditions in which the recordings provided in par. (9-1) are made and stored, as well as the measures for protecting them and the personal data, are established, under the law, by order of the minister of internal affairs."

The provisions of art. 23 par. (9-1)-(9-4) of the Government Emergency Ordinance no. 195/2002 regarding road traffic, republished, enter into force within 1 year from the date of entry into force of emergency ordinance 41.
 

OTHER AMENDMENTS:

At the same time, the criminal record certificate, a document that must be attached to the enrollment file for the driving school, will be issued by traffic police officers without the need to pay the extrajudicial stamp duty, a fee for which, until now, citizens were forced to make an extra trip to the post office. Moreover, the exemption from the extrajudicial stamp duty for issuing the criminal record is now found in Law no. 117/1999 regarding extrajudicial stamp duties, a document amended in this regard by OUG no. 41/2016.

New provisions of Law 117/1999 show that several procedures are exempt from extrajudicial stamp duties, including the examination for obtaining the driving license for the following categories of persons:

- persons with physical disabilities, for obtaining the driving license valid for motor vehicles in categories A, A1, B and B1, adapted to their disability;


- members of diplomatic missions and consular offices accredited in Romania, based on reciprocity.

The fees for the driving exam, paid more easily.

At the same time, those who pass the driving exam will now be able to pay the fee for issuing the driving license also online, through the Internet Banking service, or by bank transfer to the account opened by each prefecture in the country. In addition to these two new methods, future drivers will still be able to pay through the classic methods, namely cash or postal order.

Thus, with the entry into force of the cited normative act, the methods of paying the fees for issuing passports and driving licenses have been extended, so these fees can now be paid in four ways:

- internet banking;

- bank transfer;

- postal order;

- cash.
