The amendments of the Road Traffic Code 2015

The latest amendments brought to the Road Traffic Code, which entered into force on February 14, 2015

The latest amendments are related to the transport of children, sanctions are introduced for drivers who transport children in cars without securing them in special seats, boosters and seat belts adapted for them, they will risk being sanctioned with 487 lei. The traffic police officers proposed such a fine to force parents to be responsible and not to play with the lives of children. The fine is reduced by half if it is paid within 48 hours (2 working days).

It is strictly forbidden to transport children up to three years old in cars that are not equipped with safety systems. An exception to this rule will be made by the motor vehicles intended for public transport of persons, as well as taxis, if in the latter the child occupies any place other than the one on the front seat. However, it is allowed the transport of children without safety devices or without seat belts only when they have certificates from the doctor that exempt them from wearing them, certificates that the driver must have with him.

From January 1, the fine point increased from 90 to 97.5 lei. The reason is not any change in the Road Traffic Code, but the increase in the minimum wage. According to the Road Traffic Code, a fine point has the value of 10% of the gross minimum wage in the economy, this leading to the increase of fines. The fines will increase again on July 1, 2015, when the increase of the minimum wage to 1050 lei is foreseen, thus the value of the fine point will reach 105 lei.

The new traffic fines valid from January 1, 2015

Class I - 2-3 fine points (195 - 292.5 RON)

* Driving a motor vehicle at a speed at least 10 km/h below the mandatory minimum limit established on the respective road section;
* Failure to comply with the obligation to signal the maneuver of changing the direction of travel;
* Failure of the motor vehicle owner to request the document for ascertaining the damages produced to it in other circumstances than following an accident;
* Failure to comply with the meaning of the intermediate light signal (arrows of yellow or white colour with the tip downwards to the right) which announces the change of the green light signal in the case of lanes with reversible traffic;
* Driving a damaged vehicle beyond the term of 30 days from the date of issuing the document of ascertaining the damage;
* Failure to comply with the obligation to leave the tram route free at its approach;
* Failure to comply with the obligation to apply the distinctive sign on motor vehicles driven by persons who have less than one year of experience since obtaining the driving licence;
* Leaving free during driving the steering wheel, handlebar or the control lever of the vehicle;
* Failure to comply with the meaning of the yellow colour of the traffic light;
Driving a vehicle whose registration plates are damaged, dirty or covered with ice or snow and prevent the identification of the number;
* Driving a vehicle on which films or other devices are applied on the number plates of registration or recording that do not allow reading the registration number or the plates do not meet the standards in force;
* Driving on public roads a vehicle with technical defects or which is missing one or more body elements or it is visibly damaged;
* Incorrect use of high beam lights when encountering a motor vehicle coming from the opposite direction;
* Using mobile phones while driving, except those provided with hands-free devices;
* Failure to comply with the obligation to wear during driving on public roads the seat belt or the approved protective helmets, as the case may be;
* Exceeding by 10-20 km/h the maximum speed on the respective road section for the category to which the driven motor vehicle belongs;
* Driving on a road section on which access is prohibited;
* Failure to comply with the rules regarding the maneuver of U-turn, moving in reverse, changing the traffic lane or the direction of travel;
* Failure to comply with the obligation to use dipped headlights also during the day, on motorways, expressways and on European national roads (E);
* Irregular stopping;
* Refusal to hand over the documents provided by law, at the request of the traffic police officer, as well as the refusal to allow the vehicle to be checked;
 

Class II - 4-5 fine points (390 - 487.5 RON)

* Failure to comply with the signals of border police officers, of the guides of the Ministry of National Defence, of the railway agents, other persons designated for directing the traffic etc.;
* Failure to comply with the rules on the use of sound warning devices;
* Failure to comply with the meaning of the signs and markings of obligation;
* Failure to fulfil the obligation to request, within the term provided by law, the issuance of a duplicate of the driving licence or of the registration certificate, in case these were declared stolen, lost, damaged;
* Driving a motor vehicle that has mounted tyres with other sizes or characteristics than those provided in the registration certificate or recording or are worn beyond the allowed limit;
* Driving a motor vehicle which, in motion or stationary, causes noise pollution or emits noxes beyond the legally allowed limit;
* Performing by the driver of a vehicle activities that may distract his attention from driving or using sound systems at a noise level that affects safe driving;
* Driving a motor vehicle not equipped with a medical kit, reflective triangles and an approved fire extinguisher;
* Unjustified stopping or driving on the emergency lane of motorways or stopping on the carriageway of expressways or European national roads (E);
* Exceeding by 21-30 km/h the maximum allowed speed on the respective road section for the category to which the driven motor vehicle belongs;
* Failure to comply with the rules regarding the maneuver of U-turn, moving in reverse, changing the traffic lane or the direction of travel, if this caused an accident resulting in damage to a vehicle or other material damages;
* Failure to keep a proper distance from the vehicle ahead, if this caused an accident with damages or other material damages;
* Failure to comply with the meaning of the sign "detour", installed on the refuge of the tram stations;
* Entering an intersection when the traffic inside it is blocked;
* Irregular waiting;
* Using fog lights in conditions other than in fog.

Class III - 6-8 fine points (565 - 780 RON)

* Driving a motor vehicle with a driving licence whose validity has expired;
* Driving a motor vehicle by a person who has not exchanged the Romanian national driving licence upon changing the domicile or residence, within the term provided by law;
* Failure to fulfil the obligations of exchanging the registration certificate/recording of the motor vehicle;
* Failure to keep enough lateral distance from the vehicle coming from the opposite direction;
* Failure to comply by the driver of a vehicle with the meaning of the signs and markings of prohibition or restriction or of the temporary ones, except those that prohibit access or overtaking which fall into another class of sanctions;
* Failure to comply with the obligation to allow the driver of the vehicle remaining inside the intersection to leave it;
* Failure to reduce speed in the cases provided by the regulation;
* Installing on the motor vehicle, trailer or tram lights of another colour or intensity, other lights or sound warning devices or accessories or unauthorised modifications;
* Driving with a motor vehicle, trailer or tram with defects in the lighting or sound warning system or when these are missing;
* Failure to comply with the rules in case of involuntary immobilisation in underground passages and tunnels;
* Failure to comply with the rules regarding the transport of persons and objects in or on vehicles;
* Failure to comply with the rules regarding driving on lanes;
* Driving on public roads vehicles with two wheels, without ensuring contact with the carriageway on both wheels;
* Failure to comply with the obligations in case of vehicles left broken down or damaged;
* Failure to comply with the meaning of the "STOP" sign;
* Exceeding by 31-40 km/h the maximum allowed speed on the respective road section for the category to which the driven motor vehicle belongs, found, according to the law, with approved and metrologically verified technical means;
* Driving at night or during the day, in fog, heavy snowfall or torrential rain, with a motor vehicle without lights or without proper signalling;
* Driving a motor vehicle or towing a trailer when the substitute proof of the registration certificate or recording is issued without the right to drive or its duration has expired.

Class IV - 9-20 fine points (877.5 - 1950 RON)

* Driving on public roads a vehicle that does not meet the technical requirements or whose validity period of the periodic technical inspection has expired;
* Driving on public roads a vehicle without having mounted one of the plates with the registration number or recording or if the plates with the registration number or recording are not fixed in the specially designated places;
* Failure to perform the deregistration of vehicles from records, in the cases and terms provided by law;
* Failure to perform the periodic medical check;
* Simultaneous possession of two national driving licences, one of which issued by a competent foreign authority;
* Possession, installation or use in traffic on public roads of special sound or light warning devices on vehicles that do not have this right;
* Possession, installation or use in traffic on public roads of devices that disturb the normal operation of speed measuring devices (anti-radar devices);
* Failure to comply with the regulatory signals of railway agents at the level crossing;
* Failure to communicate by the owner or user of a vehicle, at the request of the traffic police, the identity of the person to whom he entrusted the vehicle to be driven;
* Failure to fulfil the obligation to present himself at the competent police unit in whose area the accident occurred within at most 24 hours from the event for drawing up the documents of ascertainment if from the traffic accident only material damages resulted;
* Failure to comply with the provisions regarding driving on motorways;
* Failure to comply with the meaning of the red light of the devices installed for signalling the lanes with reversible traffic;
* Committing by drivers of vehicles or their passengers of obscene gestures, uttering insults, addressing offensive or vulgar expressions to traffic participants;
* Unjustified failure to present, within the established term, at the traffic police unit to which he was invited for solving any problem related to the quality of traffic participant or vehicle owner;
* Entering public modernised roads with a vehicle that has mud on the wheels or on the body that is deposited on the carriageway or from which products, substances or materials fall or leak that endanger traffic safety;
* Transporting children up to 12 years old or animals on the front seats of vehicles;
* Driving the motor vehicle with the maximum authorised mass greater than 3.5 tons on roads covered with ice, snow or frost without having mounted on the wheels chains or other approved anti-skid equipment;
* Failure to apply, on the back of a motor vehicle registered in a state that is not a signatory of the Convention on Road Traffic, the distinctive sign of the state that performed the registration;
* Irregular waiting on public roads in conditions of reduced visibility;
* Applying chemical treatments or films on the windshield, rear window or side windows, except those approved and/or certified by the competent authority and which are properly marked;
* Applying posters, advertising, inscriptions or accessories on the windshield, rear window or side windows that restrict or blur visibility below the legally allowed limit or prevent or diminish the efficiency of the lighting and light signalling devices or reading the registration number;
* Refusal to allow the immobilisation of the vehicle or its technical inspection;
* Failure to comply with the meaning of the regulatory signals of the railway agents who direct traffic at level crossings with the railway;
* Exceeding by 41-50 km/h the maximum allowed speed on the respective road section for the category to which the driven motor vehicle belongs;
* Driving a registered or recorded vehicle that does not have mounted one of the registration or recording plates;
* Driving or waiting on the prohibited space that separates the directions of traffic on the motorway;
* Waiting or parking motor vehicles on the motorway in places other than those specially arranged and signalled;
* Performing on the motorway the maneuver of U-turn or moving in reverse, driving or crossing from one direction of travel to the other through forbidden areas, respectively the median area or the connections between the two carriageways;
* Failure to comply with the meaning of the signs "Level crossing with a single/double railway without barriers", or "Stop";
* Entering an intersection directed by traffic lights, if this produces blocking of traffic inside the intersection.
