What must you take into consideration when you intend to overtake both cyclists and groups of pedestrians who move on the carriageway?

The road traffic legislation does not provide anything in this regard.


For answer  B 

When you intend to overtake cyclists or groups of pedestrians who move on the carriageway, you will respect the legal provisions regarding overtaking, because priority is given to all vehicles and pedestrians who have this right.

In the event that the group of pedestrians is an organized group, although this is not specified, you have the obligation to drive with a speed that does not exceed 30 km/h in the urban area or 50 km/h outside built-up area when they are on the carriageway of roads with a single traffic lane per direction.

In order to ensure a proper lateral safety distance, the drivers of motor vehicles (except motor vehicles with two wheels), will perform the overtaking maneuver of bicycles or electric scooters respecting, besides the obligations regarding the overtaking maneuver, also the following obligations, depending on the speed with which they move (art. 118 paragraph 2 of the Regulation):

  • when they move with a speed of up to 50 km/h, they are obliged to perform the overtaking maneuver by crossing the longitudinal marking separating the directions of travel or the one separating the lanes in the same direction;
  • when they move with a speed greater than 50 km/h, they are obliged to perform the overtaking maneuver by crossing with at least half of the width of the motor vehicle over the longitudinal marking separating the directions of travel or the one separating the lanes in the same direction.

In conclusion, if you move with up to 50 km/h you are obliged at least to cross the marking, and if you move with more than 50 km/h you are obliged at least to cross with half of the width of the motor vehicle over the marking. These above are not just recommendations, they are obligations, and failure to respect them is sanctioned according to the law.

Note that in the event that a road section has this marking made with a continuous line you can no longer perform the overtaking of bicycles or electric scooters, because crossing or passing over this continuous line marking is prohibited, and for overtaking these vehicles crossing or passing over this marking is mandatory. The only regulatory option is to drive behind these vehicles until the end of the continuous line marking and the beginning of the discontinuous line marking that can be crossed and you can perform the overtaking of these vehicles legally.

These legislative provisions regarding the overtaking of bicycles or electric scooters were added in 2021 in the road traffic legislation.


For answer  C 

For overtaking pedestrians, a certain lateral distance is not specified, but it must be a distance that allows performing the maneuver in safety conditions. For overtaking bicycles the overtaking rules from the explanation of answer B apply.
