For answer A
Although the cyclist moves with low speed, the legislation does not provide an exception from the prohibition of breaching the continuous longitudinal marking when overtaking these vehicles, as well as when overtaking other vehicles. Thus, answer A cannot be correct.
To ensure an adequate lateral safety distance, the drivers of motor vehicles (except motor vehicles with two wheels), will perform the overtaking maneuver of bicycles or electric scooters respecting, in addition to the obligations regarding the overtaking maneuver, the following obligations, depending on the speed with which they move (art. 118 paragraph 2 of the Regulation):
In conclusion, if you move with up to 50 km/h you are obliged at least to breach the marking, and if you move with more than 50 km/h you are obliged at least to pass with half of the width of the motor vehicle over the marking. It must be noted that the above are not only recommendations, these are obligations, and their non‑observance is sanctioned according to the law.
It must be noted that in the case in which a road sector has this marking made with a continuous line the overtaking of bicycles or electric scooters cannot be performed, because the breaching or passing over this marking with continuous line is prohibited, and for the overtaking of these vehicles it is mandatory to breach or pass over this marking. The only regulatory option is to move behind these vehicles until the end of the continuous line marking and the beginning of the discontinuous line marking which can be breached and the overtaking of these vehicles can be performed in compliance with the rules.
These legislative provisions related to the overtaking of bicycles or electric scooters were added in 2021 in the road legislation.
Considering that in the situation of the question the longitudinal marking separating the directions of travel is with continuous line, it cannot be breached, in which case the legal provisions regarding the overtaking of bicycles detailed earlier cannot be respected. Therefore, you cannot perform the overtaking maneuver of cyclists in this place, being necessary to move behind them until optimal conditions for their overtaking are created.
According to the road legislation and the explanation for answer B, to ensure a lateral safety distance at the overtaking of bicycles or electric scooters, the breaching or passing over the longitudinal marking is permitted and mandatory in certain specific conditions. However, these exceptions and obligations do not apply to the longitudinal continuous marking which separates the directions of travel, whose breaching is prohibited without exceptions. Therefore, answer C is wrong.
