Overtaking the vehicles on their right side is prohibited, but in the situation where a vehicle moves faster on one of the lanes than the vehicles that move on another lane, in the same direction of travel, it is not considered overtaking. This is considered undertaking and the maneuver is lawful, regardless of the side on which the undertaking is performed.
On the roads with a single traffic lane in each direction the maneuver of undertaking cannot be performed, in which case the maneuver is called overtaking and it can be performed only on the left side of the overtaken vehicle. Undertaking is possible only on public roads with at least two traffic lanes in each direction. In this question it is about a motorway, and the motorway has at least two traffic lanes in each direction.
