The intersection in the image is directed by regulatory priority signs and the overtaking maneuver is permitted, but the motorcyclist did not correctly engage in overtaking.

The vehicle that performs the overtaking maneuver is obliged to make sure that the one that follows it or the one that precedes it have not signalled and have not engaged in a similar maneuver and must signal the intention to perform the maneuver. The motorcyclist did not respect these obligations, because the blue motor vehicle was already engaged in overtaking the truck.

Therefore the correct answer is: A

Art. 118. – The driver of the vehicle that performs overtaking is obliged:

a) to make sure that the one who follows it or the one who precedes it has not signalled the intention to begin a similar maneuver and that it can overtake without endangering or hindering the traffic from the opposite direction;

b) to signal the intention of performing the overtaking;

c) to keep during overtaking a sufficient lateral distance from the overtaken vehicle;

d) to re-enter the lane or in the initial line of traffic after it has signalled and has made sure that it can perform this maneuver in safety conditions for the overtaken vehicle and for the other participants in traffic.
