You are prohibited from increasing the travel speed when another vehicle has started overtaking the vehicle you are driving. The road traffic legislation obliges that when you are about to be overtaken, you do not increase the travel speed and you travel as close as possible to the right edge of the carriageway or of the lane on which you are traveling.
In the action area of the sign “Recommended speed” you are permitted to increase the travel speed. This sign specifies which travel speed is considered optimal for traveling in safe conditions and for ensuring a fluent traffic.
In the case in which a vehicle travels faster on one of the lanes than the vehicles that travel on another lane in the same direction of travel, it is not considered overtaking, this is called undertaking and can be performed on any of the traffic lanes of that direction. Therefore, considering that this maneuver is not considered to be overtaking, you do not have the obligation to respect not increasing the travel speed, an obligation that you have in the situation in which you are overtaken by another vehicle. Regulation** - Article 119
The driver of a vehicle who is about to be overtaken is obliged:
a) to not increase the travel speed;
b) to travel as close as possible to the right edge of the carriageway or of the lane on which he is traveling.
The road traffic legislation does not provide anything in this regard.
OUG* - Article 45
(1) Overtaking is the maneuver through which a vehicle passes in front of another vehicle or by an obstacle, located on the same direction of travel, by changing the direction of travel and exiting the traffic lane or from the line of vehicles in which it was initially.

(4) It is not considered overtaking, in the sense of paragraph (1), the situation in which a vehicle travels faster on one of the lanes than the vehicles that travel on another lane in the same direction of travel.
