Question 338 of 554

In which of the following situations is the driver of the vehicle obliged to give priority?

A when setting in motion or when entering the public road coming from an adjacent property to it, to the vehicle that travels on the public road, regardless of their direction of travel;
B when entering a local road coming from a communal road, if the intersection is uncontrolled;
C when entering a county road coming from a national road, if the intersection is uncontrolled.

Explanation

For answer  A

The road traffic legislation provides that when a driver of a vehicle sets in motion or enters the public road coming from an adjacent property to it, is obliged to give priority to vehicles that travel on the public road. In these situations, whether he sets in motion from the edge of the road or from a parking lot or exits a yard or any other type of property, the vehicle that already travels on the public road benefits from priority, regardless of its direction of travel.

For answer  B  and  C

At the uncontrolled intersection of two roads of different categories, the right‑hand priority rule does not apply, priority will be given to vehicles that travel on “the superior road”.

The right‑hand priority rule will apply in the uncontrolled intersection if the roads that intersect are of the same category (for example two communal roads or two streets in a city). If the roads that intersect are of different categories, priority will be given to vehicles that travel on “the superior road”.

The driver of the vehicle who enters a local road coming from a communal road does not have the obligation to give priority to vehicles on the local road. Communal roads are considered superior to local roads and priority is given in the opposite way: the vehicle that comes from the local road must give priority to the one from the communal road at the uncontrolled intersection. Thus, answer B cannot be correct.

Also, in the case of answer C, the vehicle that comes from a national road (considered superior) does not have to give priority when entering a county road (considered inferior) at the uncontrolled intersection. In this situation, priority is given in reverse: the vehicle on the county road must give priority to the one on the national road.

The correct answer is: A
