In what situations is prohibited the overtaking of a bicycle?

Explanation

For answer  A 

In the action area of the sign “Overtaking motor vehicles, except motorcycles without sidecar, prohibited” you are allowed the overtaking of motorcycles without sidecar and of simple vehicles, for example bicycles.


For answer  B 

Is prohibited the overtaking of all vehicles on the pedestrian crossings signalled through signs and markings. Therefore is prohibited also the overtaking of bicycles on the pedestrian crossings.


For answer  C 

You are allowed to overtake bicycles also at less than 100 meters from a level crossing with a railway, because overtaking is prohibited on the level crossings with the railway and at less than 50 meters before these.


For ensuring a corresponding lateral safety distance, the drivers of motor vehicles (except motor vehicles with two wheels), will perform the overtaking maneuver of bicycles or electric scooters respecting, besides the obligations regarding the overtaking maneuver, also the following obligations, depending on the speed with which they move (art. 118 paragraph 2 of the Regulation):

  • when they move with a speed of up to 50 km/h, they are obliged to perform the overtaking maneuver by crossing the longitudinal marking of separation of the directions of traffic or the one of separation of the lanes on the same direction of traffic;
  • when they move with a speed greater than 50 km/h, they are obliged to perform the overtaking maneuver by passing with at least half of the width of the motor vehicle over the longitudinal marking of separation of the directions of traffic or the one of separation of the lanes on the same direction of traffic.

In conclusion, if you move with up to 50 km/h you are obliged at least to cross the marking, and if you move with more than 50 km/h you are obliged at least to pass with half of the width of the motor vehicle over the marking. It must be remembered that these above are not only recommendations, these are obligations, and their non‑observance is sanctioned according to the law.

It must be remembered that in the case in which a road sector has this marking made with continuous line the overtaking of bicycles or electric scooters can no longer be performed, because is prohibited the crossing or passing over this continuous line marking, and for the overtaking of these vehicles is obligatory the crossing or passing over this marking. The only regulatory option is to move behind these vehicles until the end of the continuous line marking and the beginning of the discontinuous line marking which can be crossed and the overtaking of these vehicles can be performed in compliance with the rules.

These legislative provisions related to the overtaking of bicycles or electric scooters were added in 2021 in the road legislation.
