From the question it is understood that the tram has not yet reached the station, therefore the driver of the truck correctly performs the overtaking of the tram because the tram is not STOPPED in a station without a refuge for pedestrians and between the tram and the curb there is enough space to allow the execution of the maneuver.

Attention! If the tram was already stopped in a station WITHOUT a refuge for pedestrians, overtaking it was prohibited and he had the obligation to stop behind the tram, being able to resume traveling only after the doors of the tram had been closed and he made sure that he does not put in danger the safety of the pedestrians engaged in crossing the public road.

Art. 107.

(1) At the intersections provided with signs and/or with markings for signalling the direction of travel, the drivers of vehicles must move into position on the lanes corresponding to the intended direction of travel, at least 50 m before the intersection and they are obliged to respect the meaning of the signs and markings.

(2) At the intersections without markings for delimiting the lanes, the drivers of vehicles occupy in motion, at least 50 m before the intersection, the following positions:

a) the row next to the curb or shoulder, those who want to change the direction of travel to the right;

b) the row next to the axis of the road or next to the marking separating the directions, those who want to change the direction of travel to the left. When the traffic takes place on one-way roads, the drivers of vehicles who intend to turn left are obliged to occupy the row next to the curb or the shoulder on the left side;

c) either of the rows, those who want to go straight ahead.

(3) If trams also circulate in the intersection, and the space between the right rail and the sidewalk does not allow circulation on two or more rows, all drivers of vehicles, regardless of the direction of travel, will travel on a single row, leaving free the route of the tram.

(4) In the case in which the tram is stopped in a station without a refuge for pedestrians, the vehicles must stop in the order of arrival, behind it, and resume traveling only after the doors of the tram have been closed and they have made sure that they do not put in danger the safety of the pedestrians engaged in crossing the public road.
