Trams are overtaken as a rule on the right side, but trams in motion may also be overtaken on the left side when between the right rail and the edge of the sidewalk there is not enough space for performing the maneuver or when the road is one-way.

Therefore the overtaking of the tram in the image is legal because the “No entry” sign in the image is usually placed on one-way streets, on the direction prohibited to traffic, in this case, the road being one-way, overtaking the tram on the left side is allowed.

Art. 45.

(1) Overtaking is the maneuver by which a vehicle passes in front of another vehicle or past an obstacle, located on the same traffic direction, by changing the direction of travel and leaving the traffic lane or the line of vehicles in which it was initially.

(2) The driver of the vehicle who starts overtaking must make sure that the vehicle traveling in front or behind him has not initiated such a maneuver.

(3) When by the overtaking maneuver the axis that separates the traffic directions is crossed, the drivers of vehicles must make sure that from the opposite direction no vehicle is approaching and that they have enough space to return to the initial lane, where they are obliged to return after performing the overtaking maneuver.

(4) It does not constitute overtaking, within the meaning of paragraph (1), the situation in which a vehicle travels faster on one of the lanes than the vehicles traveling on another lane in the same traffic direction.

(5) Overtaking is performed only on the left side of the overtaken vehicle. The tram or the vehicle whose driver has signaled the intention and has positioned correctly for leaving the traffic direction to the left is overtaken on the right side.

(6) The tram in motion may also be overtaken on the left side when the road is one-way or when between the right rail and the edge of the sidewalk there is not enough space.
