How do you proceed in the situation where the red signal of the traffic light is operating, and the traffic police officer addresses you the signal to pass?

B you draw the attention of the traffic police officer that there is a discrepancy between his signal and that of the traffic light;
C you respect the signal of the traffic police officer.

Explanation

The participants in traffic must respect the traffic rules, the signals, the indications and the instructions of the traffic police officer, as well as the meaning of the different types of road signalling means, in the following order of priority:

  • the signals, the indications and the instructions of the traffic police officer will be respected with priority over all other signalling means (these having the highest degree of priority);
  • in the absence of the traffic police officer, we will respect with priority: the special warning signals, light and sound, of the motor vehicles with priority traffic regime (provided in art. 32 paragraph 2 letter a and b of OUG);
  • in the absence of the special warning signals, light and sound, of the motor vehicles with priority traffic regime, we will respect with priority the temporary signalling and/or the electronic signs, which modify the normal traffic flow;
  • in the absence of the temporary signalling which modifies the normal traffic flow, we will respect with priority: the light or sound signals;
  • in the absence of the light or sound signals, we will respect with priority: the road signs;
  • in the absence of the road signs, we will respect with priority: the road markings;
  • in the absence of the road markings, we will respect with priority: the traffic rules.

The signals, the indications and the instructions of the traffic police officer will be respected with priority regardless of the situation. Therefore, in the situation in which the traffic police officer addresses you a signal to pass, you are obliged to respect the signal addressed by him, even if the traffic light indicates the red colour.

(1) The signals of the police officer who directs the traffic have the following meanings:

(2) The police officer who directs the traffic may make a signal with the arm for the vehicle to advance, to overtake, to pass in front of or behind him, to bypass him on his left or right side, and for the pedestrians to cross the road or to stop.
