In the situation where the service braking system (foot brake) and/or the security or parking braking system (hand brake) present defects, the registration certificate is retained, and the following sanctions are also applied:

  • in the case where it is about major deficienciesthe contravention fine provided in the third class of sanctions is applied;
  • in the case where it is about dangerous deficienciesthe contravention fine provided in the fourth class of sanctions is applied and the retention of the driving license with a view to suspending the exercise of the right to drive for a period of 90 days is applied, a replacement proof with the right to drive for a period of 15 days is issued and the vehicle is immobilized.
