Art.36.

(1) The drivers of motor vehicles and the persons who occupy seats provided by construction with approved seat belts or safety devices must wear them while driving on public roads, except for the cases provided in the regulation.

(1.1) The drivers of motor vehicles having seats provided by construction with seat belts must inform the passengers about the legal obligation to wear them while driving on public roads.

(1.2) The drivers of motor vehicles having seats provided by construction with seat belts are obliged to make sure that, while driving the vehicle, minors wear the seat belts or are transported only in approved child restraint systems, under the conditions provided by the regulation.

(1.3) The drivers of motor vehicles are prohibited from transporting children under 3 years old in motor vehicles that are not equipped with safety systems, except for those intended for public passenger transport, as well as taxis if in the latter they occupy any seat other than the front seat, under the conditions provided in the regulation. Children over 3 years old, having a height of up to 150 cm, may be transported in motor vehicles that are not equipped with safety systems only if they occupy, during transport, any seat other than the front seat.

(2) While traveling on public roads, the drivers of motorcycles, mopeds and the persons transported on them are obliged to wear an approved protective helmet.

(3) The drivers of vehicles are prohibited from using mobile phones when they are in motion, except for those equipped with hands-free devices.
