OUG = GOVERNMENT EMERGENCY ORDINANCE no. 195 of December 12, 2002 (Road Traffic Code)
Regulation = REGULATION for the implementation of OUG 195/2002 (Road Traffic Code Regulation)

(1) At the request of the traffic police or the local police, the owner or the mandated holder of a vehicle is obliged to communicate to it, within the term indicated in the content of the request, the identification data of the person to whom he entrusted the vehicle to drive it on public roads. The local police may request this identification data only in connection with the exercise of competences in the field of traffic on public roads. (2) The obligation to communicate the identification data, provided in paragraph (1), is considered fulfilled if the owner or the mandated holder of a vehicle communicates the surname, first name, personal numeric code, domicile or residence, the number and series of the identity document of the person to whom he entrusted the vehicle to drive it on public roads or, in the case of foreign citizens, stateless persons or Romanian citizens domiciled abroad, also the series and number of the passport or of another state border crossing document, the date of its issuance and the issuing state.
(1) The owner of a motor vehicle or trailer, with domicile, headquarters or residence in Romania, is obliged:
a) to declare to the issuing authority the loss, theft or destruction of the registration certificate, within at most 48 hours from the finding;
b) to immediately submit to the issuing authority the original of the registration certificate, if, after obtaining the duplicate, he has regained possession of it.
(2) Legal entities holding vehicles have, in addition to those provided in paragraph (1), the following obligations:
a) to check the technical condition of the vehicles, to make mentions about it in the trip sheet or service order and to not allow the departure in traffic of those that do not meet the technical conditions;
b) to issue a trip sheet or service order for the vehicles that travel on the route;
c) to not allow the driving of the vehicle by persons who do not hold the appropriate driving licence or professional certificate;
d) to not allow the drivers of vehicles to leave on the route under the influence of alcoholic beverages, psychoactive substances or in a pronounced state of fatigue; (Point d) was amended in the law and also updated on Școala Rutieră on 06-10-2021)
e) to take into account the observations made by traffic police officers or by the drivers of vehicles in the trip sheet;
f) to immediately inform the police about any traffic accident in which the drivers of their own vehicles are involved who do not have documents for its finding;
g) to check the observance of rest and break times, as well as of the legal speed limit, by reading the recordings of the devices for monitoring the rest times and the travel speed;
h) to check the existence of the special transport authorization and the observance of the conditions written in it.
(1) Vehicle holders may install on them anti-theft sound systems.
(2) The duration of the signal emitted by the system provided in paragraph (1) must not be longer than one minute, and its intensity must not exceed the sound threshold provided in the legal regulations in force.
(3) Is prohibited the installation on vehicles of anti-theft sound systems that are triggered by the passing, in immediate proximity, of another vehicle.

Legal persons holding vehicles have the following obligations (art. 27 paragraph 2 of the Regulation):

This obligation is considered fulfilled if the surname, first name, personal numeric code, domicile or residence, the number and series of the identity document of that person or, in the case of foreign citizens, stateless persons or Romanian citizens domiciled abroad, also the series and number of the passport or of another state border crossing document, the date of its issuance and the issuing state are communicated. (art. 39 paragraph 2 of OUG)
Vehicle holders may install on them anti-theft sound systems. The duration of the signal emitted by the anti-theft sound system must not be longer than one minute, and its intensity must not exceed the sound threshold provided in the legal regulations in force. Is prohibited the installation on vehicles of anti-theft sound systems that are triggered by the passing, in immediate proximity, of another vehicle (art. 28 of the Regulation).
