OUG - Article 99

(1) Constitute contraventions and are sanctioned with the fine provided in class I of sanctions the following acts committed by natural persons:

1. driving a motor vehicle unjustifiably with a speed at least 10 km/h below the minimum mandatory limit established on the respective road section;
2. non‑observance of the obligation to signal the maneuver of changing the direction of travel;
3. non‑observance by pedestrians of the rules regarding traffic on public roads;
4. failure by the owner or user of a motor vehicle and agricultural or forestry tractor to request the damage assessment document issued for it in circumstances other than following a traffic accident;
5. non‑observance of the rules regarding traffic on public roads by the leaders of military columns, of authorized organized groups and of processions;
6. non‑observance of the meaning of the intermediate light signal in the shape of one or several yellow or white arrows with the tip pointing downwards to the right, which announces the change of the green light in the case of reversible traffic lanes;
7. driving a damaged vehicle beyond the term of 30 days from the date of issuance of the damage assessment document;
8. non‑observance of the obligation of passengers in a motor vehicle and agricultural or forestry tractor to wear, during travel on public roads, the approved seat belt or safety devices;
9. non‑observance of the obligation by the person transported on a motorcycle or moped to wear, during travel on public roads, the approved protective helmet;
10. Non‑observance of the obligation of the driver of the vehicle, except for the driver of the motor vehicle intended for public passenger transport through regular services, to leave the tram free at its approach, when the road has a single lane; (Point 10 was amended in the law and also updated on Școala Rutieră on 09-04-2020)
11. non‑observance of the traffic rules by animal drivers;
12. non‑observance of the obligation to apply the distinctive sign on motor vehicles and agricultural or forestry tractors driven by persons who have less than one year of experience from obtaining the driving license;
13. leaving free while driving the steering wheel, the handlebar or the control lever of the vehicle;
14. non‑observance by passengers or travellers of the obligations incumbent on them when they are in vehicles;
15. non‑observance of the meaning of the yellow colour of the traffic light;
16. driving a vehicle whose registration or record number plates are damaged, dirty or covered with ice or snow in a manner that prevents the identification of the registration or record number;
17. driving a vehicle on whose registration or record number plates are applied foils or other devices that do not allow the reading of the registration number or the plates do not comply with the standards in force;
18. driving on public roads a vehicle with major deficiencies, other than those provided in art. 101 paragraph (1) point 11; ( Art. 101 paragraph (1) point 11. driving a motor vehicle, agricultural or forestry tractor, trailer or tram with major deficiencies to the braking system or steering mechanism, to the lighting or sound warning system or when they are missing).

(2) The contravention fine provided in paragraph (1) also applies to the driver of a motor vehicle, agricultural or forestry tractor or tram who commits an act for which 2 penalty points apply, according to art. 108 paragraph (1) letter a).

OUG - Article 108

(1) The commission by the driver of a motor vehicle, agricultural or forestry tractor or tram of one or more contraventions entails, in addition to the fine sanction, the application of a number of penalty points, as follows:

a) 2 penalty points for committing the following acts:

1. incorrect use of the high‑beam lights when encountering a motor vehicle and agricultural or forestry tractor coming from the opposite direction;
2. repealed;
3. non‑observance of the obligation to wear, during travel on public roads, the seat belt or the approved protective helmets, as the case may be;
4. exceeding by 10-20 km/h the maximum speed allowed on the respective road sector for the category to which the driven motor vehicle belongs, found, according to the law, with approved and metrologically verified technical means;
5. traffic on a road sector on which access is prohibited;
6. non‑observance of the rules regarding the maneuver of turning, moving in reverse, changing the traffic lane or the direction of travel;
7. non‑observance of the obligation to use also during the day the low‑beam lights or the daytime running lights, on all categories of public roads; (Point 7 was amended in the law and also updated on Școala Rutieră on 16-06-2023)
8. irregular stopping;
9. incorrect use of the high‑beam lights with respect to the motor vehicle and agricultural or forestry tractor travelling in front of it, in the same direction of travel.

CONTRAVENTIONS: CLASS I OF SANCTIONS 2 - 3 FINE POINTS

3. non‑observance by pedestrians of the rules regarding traffic on public roads;

The fine provided in class I of sanctions also applies to the driver of a motor vehicle, agricultural or forestry tractor or tram who commits an act for which 2 penalty points apply, these acts are (art. 99 paragraph 2 and art. 108 paragraph 1 letter a of OUG):

1. incorrect use of the high‑beam lights when encountering a motor vehicle and agricultural or forestry tractor coming from the opposite direction; 
2. non‑observance of the obligation to wear, during travel on public roads, the seat belt or the approved protective helmets, as the case may be; 
3. exceeding by 10-20 km/h the maximum speed allowed on the respective road sector for the category to which the driven motor vehicle belongs, found, according to the law, with approved and metrologically verified technical means;
