Preventing or hindering traffic on public roads
(1) The installation of road signalling means or the modification of their positions, without an authorization issued by the competent authorities, likely to mislead road users or to hinder traffic on the public road is punished by imprisonment from 3 months to 2 years or by a fine.
(2) Participation as the driver of a vehicle in unauthorized races on public roads is punished by imprisonment from 3 months to one year or by a fine.
(3) The placement of obstacles that hinder or prevent traffic on the public road, if the safety of traffic is endangered or the right to free movement of the other road users is harmed, is punished with the same penalty.
(4) Leaving unsupervised on the carriageway of the public road a vehicle transporting dangerous products or substances is punished by imprisonment from one to 3 years or by a fine.
Failure to comply with duties regarding technical verification or repairs
(1) Faulty fulfilment or non-fulfilment of duties of technical verification or periodic technical inspection of motor vehicles, trailers or trams, or those regarding the carrying out of repairs or technical interventions by persons who have such duties, if due to the technical condition of the vehicle traffic safety on public roads was endangered, is punished by imprisonment from 3 months to 2 years or by a fine.
(2) If, as a result of the act provided in paragraph (1), a traffic accident occurred which resulted in bodily injury or health damage of one or more persons, the penalty is imprisonment from one to 5 years, and if the death of one or more persons occurred, the penalty is imprisonment from 3 to 10 years.
(3) If the acts provided in paragraph (1) and paragraph (2) were committed by negligence, the special limits of the penalty are reduced by one third.
(4) Repairing motor vehicles, trailers, trams or mopeds having accident marks, without fulfilling the conditions provided by law, is punished by imprisonment from 3 months to 2 years or by a fine.
Carrying out unauthorized works in the public road area
(1) Carrying out construction, modification, modernization or rehabilitation works of the public road or arranging road access to the public road, without a construction authorization issued under the conditions of the law or in violation of the conditions established in the authorization, is punished by imprisonment from 6 months to 3 years or by a fine.
(2) Placing constructions, panels or advertising billboards in the road area, without a construction authorization issued under the conditions of the law or in violation of the conditions established in the authorization, if this creates a danger to traffic safety, is punished by imprisonment from 3 months to one year or by a fine.
(3) The person authorized by the railway administrator who does not take appropriate measures for signalling level crossings with the railway is punished by imprisonment from 3 months to 2 years or by a fine.
(4) With the penalty provided in paragraph (3) is sanctioned also the person authorized by the administrator of a public road or the performer of works on the carriageway, who does not take appropriate measures for signalling obstacles or works on public roads, if a traffic accident was produced thereby.
